Acceptance of Terms

By accessing or using Flexylen's services, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you may not access or use our services.

These terms apply to all users of the platform, including learners, instructors, examiners, and administrators. Additional terms may apply to specific features or services, which will be presented to you when you access those features.

Use of Platform

You may use Flexylen only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the platform in any way that violates applicable laws or regulations
• Impersonate any person or entity, or falsely state your affiliation
• Interfere with or disrupt the platform or servers connected to it
• Attempt to gain unauthorised access to any part of the platform
• Use automated systems or software to extract data from the platform
• Upload or transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users of the platform
• Share account credentials with unauthorised parties

We reserve the right to suspend or terminate your access to the platform for any violation of these terms.

Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring your account information remains accurate and up-to-date

Organisation administrators are responsible for managing user access within their organisation and ensuring all members comply with these terms.

Payment

Subscription fees are billed in advance on a monthly or annual basis. By subscribing to a paid plan, you authorise us to charge your payment method for all fees incurred.

Key payment terms:

• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days notice
• Failed payments may result in service suspension
• You are responsible for all applicable taxes

We may offer free trials. At the end of any free trial, you will be automatically charged unless you cancel before the trial ends.

Intellectual Property

The Flexylen platform, including its original content, features, and functionality, is owned by Flexylen and protected by international copyright, trademark, and other intellectual property laws.

Regarding user content:

• You retain ownership of content you upload to the platform
• You grant us a licence to use, store, and display your content to provide our services
• You represent that you have the rights to any content you upload
• Organisation-created courses remain the property of that organisation

You may not copy, modify, distribute, or create derivative works of our platform without our express written permission.

Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice, for any reason, including:

• Violation of these Terms and Conditions
• Non-payment of applicable fees
• Request by law enforcement or government agencies
• Unexpected technical or security issues
• Extended periods of inactivity

Upon termination, your right to use the platform will immediately cease. You may request a copy of your data within 30 days of termination.

Limitation of Liability

To the maximum extent permitted by law, Flexylen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute services
• Any damages arising from your use of the platform

Our total liability for any claims arising from these terms or your use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of the platform shall be resolved exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of such courts.
